These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Devity ("we," "us," or "our"), governing your access to and use of the Samvaad mobile application and the website located at samvaad.app (collectively, the "Service").
By creating an account, downloading the app, or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 13 years of age (or the minimum age required by applicable law in your jurisdiction) to create an account and use the Service. If you are under the age of 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Samvaad is a Kannada language learning application designed for beginners living in or relocating to Karnataka. The Service provides structured lessons, listening and speaking exercises, Kannada script tracing, adaptive practice, and gamification features (including XP, streaks, daily quests, and leaderboards) through a guided learning path.
The Service is available on Android via Google Play. Certain features are available free of charge; additional features are available through a Premium subscription (see Section 5).
You agree to use the Service only for its intended purpose of personal language learning. You shall not:
We reserve the right to suspend or terminate your access to the Service if we determine, in our sole discretion, that you have violated these Terms.
Samvaad offers an optional Premium subscription that provides additional features, including but not limited to: unlimited hearts, extended streak protection (up to four freezes), speaking sprint exercises, and personalised focus recommendations. Pricing, subscription periods, and available plans are displayed within the app at the time of purchase.
Premium subscriptions are processed and billed through Google Play. By purchasing a subscription, you agree to the applicable pricing and payment terms presented at the time of purchase, as well as Google Play's terms of service. All payments are processed by Google; we do not directly collect or store your payment card details.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You may cancel your subscription at any time through the Google Play Store app or your Google Play account settings. Cancellation takes effect at the end of the current billing period; you will retain access to Premium features until that date.
Refund requests are subject to the refund policies of Google Play. We do not process refunds directly. For refund inquiries, please refer to Google Play's refund policy or contact Google Play support.
All content, materials, and features available through the Service — including but not limited to text, audio recordings, graphics, illustrations (including the character "Kavi"), user interface design, lesson content, and software code — are owned by or licensed to Devity and are protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial language learning purposes. This licence does not include the right to sublicence, sell, or distribute any part of the Service.
Where the Service allows you to submit content (such as feedback, support requests, or survey responses), you retain ownership of that content. By submitting content to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and process such content solely for the purpose of operating, improving, and supporting the Service.
You represent and warrant that any content you submit does not infringe the intellectual property rights or other rights of any third party and does not contain unlawful or objectionable material.
You may request deletion of your account and all associated data at any time through the Account Deletion page on our website. Upon receiving your request, we will permanently delete your account and all associated data — including lesson progress, scores, preferences, and settings — within 7 business days. This action is irreversible.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
To the fullest extent permitted by applicable law, in no event shall Devity, its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your access to or use of (or inability to access or use) the Service, regardless of the theory of liability and whether or not we have been advised of the possibility of such damages.
To the extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us, if any, in the 12 months preceding the event giving rise to the claim, or fifty Indian Rupees (INR 50), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Devity, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
The Service relies on third-party platforms and services, including Google Play, Google Firebase, and Google Analytics. Your use of these third-party services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service, provided that if a material change adversely affects your paid subscription, we will use reasonable efforts to notify you in advance.
We may revise these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where required by law, provide additional notice (such as in-app notification or email). Your continued use of the Service after the revised Terms take effect constitutes acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Devity with respect to the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
